ARTICLE 7: APPLICABLE LEGISLATION

Italian law applies to the relationships between B-UNUSUAL.CO and the User.

General terms and conditions of sale

These general conditions of sale (hereinafter, the “General Conditions”) are valid exclusively between the company B-UNUSUAL.CO with registered office in Via ____________ C.F. / VAT number ________ (hereinafter, “B.UNUSUAL”), and any person, hereinafter referred to as “the Customer”, who makes online purchases on the website www.B.UNUSUAL.CO. The Customer declares to have read and understood the General Conditions, as they are published on the website WWW.B-UNUSUAL.CO. B.UNUSUAL reserves the right to unilaterally adapt these General Conditions, modifying them on the WWW.B-UNUSUAL.CO website. The date of publication of the same on the website is equivalent to the date of entry into force. These General Conditions govern purchases made on the WWW.B-UNUSUAL.CO website in accordance with the provisions of the Consumer Code, Legislative Decree. n. 206/2005, modified by Legislative Decree. n. 21/2014 and by Legislative Decree. 70/2003 regarding electronic commerce.

Subject of the contract

Under the discipline of these General Conditions, B.UNUSUAL sells to the Customer, who purchases remotely, the goods indicated and offered for sale on the WWW.B-UNUSUAL.CO website. The contract is concluded exclusively electronically, through the internet, through the Customer’s access to the address WWW.B-UNUSUAL.CO The products are sold with the characteristics described on the site indicated above. The images relating to the items for sale on the WWW.B-UNUSUAL.CO website are representative of B.UNUSUAL jewels and have the purpose of presenting the product. However, the illustrations may not represent all aspects of the actual product, and there may be slight chromatic or aesthetic/morphological differences, due solely to the photographic reproduction process. Any such discrepancies cannot be the subject of claims by the Customer.

Acceptance of general terms and conditions

The Customer, by sending his purchase order electronically, declares that he has read and accepted these General Conditions and undertakes to observe and respect them in his relations with B.UNUSUAL. These General Conditions apply automatically to all purchases made by the Customer through the WWW.B-UNUSUAL.CO website and will remain applicable indefinitely.

Mode of purchase

The Customer purchases the product, the characteristics of which are illustrated online in the relevant descriptive and technical data sheets, at the price indicated therein. The contract stipulated between the Customer and B.UNUSUAL is considered concluded when the order submitted by the Customer is correctly processed, i.e. the product is delivered to the Customer’s address, provided that B.UNUSUAL has received confirmation of the authorization to pay the total amount due and/or that the availability of the product has been confirmed by B.UNUSUAL. The order sent by the Customer will therefore be binding for B.UNUSUAL only if the aforementioned conditions occur. B.UNUSUAL is not responsible for malfunctions of the data transmission network attributable to the operator. The purchase order received will be archived in the site database for the period of time necessary to process it.

Before taking charge of the order, B.UNUSUAL will send the Customer, by e-mail, a confirmation of receipt of the purchase order sent, containing a summary of the essential characteristics of the products purchased, a detailed indication of the price, the payment method chosen by the Customer. The customer must, without delay, verify the content of the communication and immediately report any errors or omissions to B.UNUSUAL at info@b-unusual.co

Prices and payment terms

- All product prices indicated on the WWW.B-UNUSUAL.CO website include VAT and shipping costs. The prices of the products may be subject to updates, at any time, by B.UNUSUAL. In any case, the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation email sent by B.UNUSUAL to the Customer. The customer can make the payment due by choosing one of the following methods listed:

B.UNUSUAL will not be responsible for any illicit or fraudulent use that may be made by third parties of credit cards or other means of payment, at the time of purchasing the product, as they are not, in at no time during the purchase procedure, able to know the Customer’s credit card number which, through a secure connection, is transmitted directly to the banking service manager. Delivery of products
  
  The delivery of the products ordered by the Customer will take place in the manner selected by the Customer among those available and indicated on the site at the time the order is sent. The products purchased on the site indicated above are delivered in special packaging which guarantees their safety and integrity even during transport. The purchased good, together with the relevant invoice, is delivered by courier to the delivery address specified by the Customer when ordering online. Delivery time is estimated at 3/7 working days and may vary per product and size/colour variant. If paying by credit card, there may be a change in delivery times due to administrative checks. In case of payment by bank transfer, shipping times will be calculated starting from the date of confirmation of credit. The delivery term indicated in the order must not be considered mandatory or essential for the execution of the contract. In any case, the Customer will not be able to request termination of the contract before 40 days have passed from confirmation of the order and before an additional term of 15 days has been granted to B.UNUSUAL.

The shipment can be tracked by the Customer, from the courier’s website, by entering the references that B.UNUSUAL will communicate via email to the Customer. The Customer undertakes to promptly check, and in any case no later than 14 days from the delivery date, that it includes all and only the products purchased and to promptly inform B.UNUSUAL in writing of any possible defect in the products received; otherwise the products will be considered accepted. Upon delivery of the goods by the courier, the Customer is required to check that: (a) the number of packages delivered corresponds to that indicated in the consignment note; (b) the packaging is intact, not damaged, wet or otherwise altered, including the closing materials. Any damage to the packaging and/or mismatch in the number of packages must be immediately reported, placing a written control reservation on the courier’s proof of delivery. Once the courier document has been signed, the Customer will not be able to make any objections regarding the external characteristics of what was delivered. No responsibility can be attributed to B.UNUSUAL for delayed or non-delivery attributable to force majeure (such as, but not limited to, acts of war, strikes, states of emergency at national or local level, failure of transport infrastructures , malfunctions and disservices of the internet network, earthquakes) or unforeseeable circumstances.

Product availability

The availability of the products must be understood as referring to the moment in which the Customer places the order. This availability must however be considered indicative as (a) the products could be sold to other Customers before the order confirmation, due to the simultaneous presence on the site of multiple users, and (b) an IT anomaly could occur such as to make a product available for purchase that in reality is not. Even after sending the order confirmation email sent by B.UNUSUAL, cases of unavailability of the goods may occur. In this case, the order will be corrected with the elimination of the unavailable product and the Customer will be informed immediately via e-mail. With this communication the Customer will be informed of the methods and timing of reimbursement of any sums paid and to be returned.

Complaints

For any complaints or clarifications, the Customer must contact the following address via email: info@b-unusual.co. The Customer will be contacted for clarifications within 3 working days of the request. If the Customer detects defects or lack of conformity of the purchased product, B.UNUSUAL will arrange for the free collection of the object and the replacement and/or repair of the same, bearing the return shipping costs, after having verified the actual presence of the manufacturing defect, excluding that the product has been worn or used and damaged. If B.UNUSUAL does not detect any lack of conformity, the company undertakes to contact the Customer, providing the cost estimate for any repair and/or replacement, which will only be carried out with the written consent of the Customer. In this case, shipping costs will be charged to the Customer. The repair and/or replacement will be carried out following payment of the repair and shipping costs. In the event that the Customer requests the return of the item without repair and/or replacement, the shipping costs will be charged to the Customer. In the absence of communications from the Customer, B.UNUSUAL is not responsible for objects in storage for more than 3 months.

Returns and Refunds

The Customer who for any reason is not satisfied with the purchase made has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 14 days of receipt. To make any return, the Customer must send an email with the return request to the B.UNUSUAL customer service, which will communicate the instructions on the return methods. The purchased good, subject to return, must be returned to B.UNUSUAL in its original packaging, accompanied by the guarantee certificate. The shipping costs to be paid for returning the product are borne by B.UNUSUAL. In case of withdrawal, B.UNUSUAL will refund the entire amount paid by the Customer within 30 days from the date of receipt of the goods shipped by the Customer. Refunds will be made with the same payment method provided for the purchase. It is understood that B.UNUSUAL will not be responsible for those products returned that are lost, stolen or damaged, therefore not proceeding with refunds or compensation. The right of withdrawal is inapplicable in the case of the purchase of tailor-made or personalized goods.

Industrial and intellectual property law

All contents published or present on the WWW.B.UNUSUAL.CO website including their selection and organization, as well as the design of the site, belong solely to B.UNUSUAL and are protected by legislation on the protection of intellectual property and rights author’s. It is therefore prohibited to modify, copy, reproduce, distribute, transmit or disseminate the content of this site without authorization. No one may use or have used images or contents of the website for commercial purposes. Any use for commercial intent or utility or economic exploitation by users is therefore expressly prohibited.

Applicable law and competent court This contract is regulated by the Italian law. For any dispute that may arise between the parties for the interpretation, application and/or execution of these General Conditions, the Court of Vicenza will have exclusive jurisdiction.
